When governments or international organisations refuse to honour their contractual obligations with private investors, or vice-versa, Nick Kaufman will advise as to alternative dispute resolution mechanisms including ad hoc arbitration and State-investor arbitration within the framework of bilateral investment treaties under the auspices of the International Centre for the Settlement of Investment Disputes (ICSID).

Nick Kaufman has advised, inter alia, in the following matters:

Besserglik v. Mozambique: acting for the claimant in a State-Investor dispute pertaining to the alleged expropriation of prawn-fishing quotas;

Rosenblum v. Liberia; acting for the claimant in an ad hoc arbitration concerning the alleged failure by the Government of Liberia to honour its contractual undertakings in relation to two road infrastructure projects.

Ahmed Jalal Mohamed Abd al-Qadr v. Israel: acting for the claimants in a dispute over liability and compensation for the deaths of four Egyptian soldiers on the border with Israel. 

El-Shahabiyyeh v. UNRWA (United Nations Relief and Works Agency): acting for the claimant in an ad hoc arbitration concerning a construction project in Gaza frustrated by Israeli military operations.
